The Western Australian Commissioner for Equal Opportunity is responsible for the administration of the Equal Opportunity Act 1984. The main objective of the Act is to:
“promote equality of opportunity in Western Australia and to provide remedies in respect of discrimination on the grounds of sex, marital status, pregnancy, sexual orientation, family responsibility or family status, race, religious or political conviction, impairment, or age, or involving sexual or racial harassment or, in certain cases, on gender history grounds.”
The Commissioner carries out this role by conducting community education and training, investigating and conciliating complaints of discrimination and providing information to the community about equal opportunity.
United Nations Convention on the Rights of Persons with Disabilities (CRPD)
The Convention is intended as a human rights instrument with an explicit, social development dimension. It adopts a broad categorisation of persons with disabilities and reaffirms that all persons with all types of disabilities must enjoy all human rights and fundamental freedoms. It clarifies and qualifies how all categories of rights apply to persons with disabilities and identifies areas where adaptations have to be made for persons with disabilities to effectively exercise their rights and areas where their rights have been violated, and where protection of rights must be reinforced.
Disability Discrimination Act 1992
The objects of this Act are:
- to eliminate, as far as possible, discrimination against persons on the ground of disability in the areas of:
- work, accommodation, education, access to premises, clubs and sport; and
- the provision of goods,facilities, services and land; and
- existing laws; and
- the administration of Commonwealth laws and programs; and
- to ensure, as far as practicable, that persons with disabilities have the same rights to equality before the law as the rest of the community; and
- to promote recognition and acceptance within the community of the principle that persons with disabilities have the same fundamental rights as the rest of the community.
The NDIS Quality and Safeguards Commission is an independent agency established to improve the quality and safety of NDIS supports and services.
They regulate NDIS providers, provide national consistency, promote safety and quality services, resolve problems and identify areas for improvement.
The NDIS is Australia’s first national Scheme for people with disability. It provides funding directly to individuals.
The NDIS can provide all people with disability with information and connections to services in their communities such as doctors, sporting clubs, support groups, libraries and schools, as well as information about what support is provided by each state and territory government.
Western Australia is working closely with the Commonwealth and state and territory jurisdictional governments to respond appropriately to the coronavirus pandemic.
